GENERAL TERMS AND CONDITIONS
To ensure the peaceful enjoyment by all our guests, we require all guests to agree to the same rules of engagement by agreeing to the following terms and conditions:
1. GENERAL
It is agreed and understood that Springwood Cottage Resort at 1018 Blue Heron Ridge Rd. Arden Ontario K0H 1B0 (“Resort”) is owned and operated by 2796017 Ontario Inc (“Host”) and has offered to the guest (“Guest”) as vacation rental accommodation certain cottage(s) (“Cottage”) as well as access to the Resort, according to the terms and conditions set out below.
The Guest agrees to abide by the terms and conditions set out herein and as set out by the Host in the Resort Rules and Policies as posted on the Host’s web-site (www.springwoodcottageresort.ca) (“Website”), in the Cottage or on the Resort and shall be responsible for adherence to terms and conditions by any and all of their occupants, visitors and guests.
2. CHECK-IN / CHECK-OUT
Check-in: After 3:00pm EST
Check-out: Before 10:00am EST
Check Guest shall Check-In and Check out in accordance with the times indicated above or as agreed to in advance of Check-In. The Guest will be liable for any cost of whatever nature incurred because of an unauthorized extension of their stay. The Guest is not entitled to any refund resulting from early departure.
3. DAMAGE DEPOSIT
At the time of check-in, Guest is to provide a Damage Deposit of $250 per Cottage rented which will be processed in the form of a pre-authorization on a major credit card. In the event, that the guest does not have a major credit card, the Host will accept a $500 cash Damage Deposit instead. The Damage Deposit will be returned by the Host to the Guest within 7 days after check-out by the Guest. During this time the Host will have had an opportunity to inspect the Cottage for any damage and ensure no claims or charges are pending.
All or part of the Damage Deposit may be used for penalties, fees, charges, additional cleaning required, breakage or damage to inventory, equipment or any other part of the Cottage or Resort above and beyond normal “wear and tear” at the sole discretion of the Host. The Guest agrees to assume responsibility for any and all costs and charges in excess of the Damage Deposit.
4. REPRESENTATION
The information contained in any printed material, photograph or posting on our web site is believed to be accurate at the time of publication. The Host reserves the right to make any changes it deems necessary to more accurately reflect the Resort. While every attempt will be made to ensure that equipment and appliances are in working order, should any breakdown or other situation occur whereby these elements are not available during the term of the rental period, the Host will make reasonable efforts to resolve in a satisfactory manner, however does not take responsibility for fixing, replacing or refunding the Guest for the lack of use of these elements.
5. NON-AVAILABILITY OF PROPERTY
If for any reason beyond the Host’s control the Cottage is not available on the date booked
(owing to fire damage or Public Health measures for example), or the Cottage is unsuitable for rental, all rent and charges paid in advance by the Guest will be refunded in full, but the Guest shall have no further claim against the Host. This does not apply to power outages that may occur prior to a rental commencing where the electricity supplier is in the process of restoring power within 48 hours.
6. SECURITY CAMERAS
To protect guests and staff, deter theft, vandalism and property damage and to reduce the risk of criminal activity and suspicious behaviour, the Host has installed security cameras around the Resort. The security cameras are visible and are used for the limited purposes of monitoring the conduct of individuals who may pose a risk to our guests or staff, steal or cause property damage. The security cameras are in common areas around the Resort and are all visible. Specifically, security cameras are in the following locations:
- In and outside of the General Store
- At the Marina
- In and outside the Maintenance Building
- In the Games Room
There are no security cameras inside the cottages or other private rental areas on the Resort and are used for the sole purpose of protecting guests, staff and the Resort.
7. PHOTOGRAPHS/VIDEO CLIPS
On occasion, the Host (or representatives thereof) may take photographs and/or video clips around the Resort for purposes of marketing the Resort. The Host will strive to make it known when we are doing so with any guests who may be in the pictures and where they may be recognisable. Guests may advise the Host at the time to not photograph or publish photographs with the Guest, which the Host will oblige. Otherwise, the Guest consent to photographs taken of them while participating in activities in “public” areas of the Resort, and to the publication of the photographs by the Host for advertising, promotional and marketing purposes. The Guest also assigns a non-exclusive, royalty-free license to use photos submitted by them to the Host and any photos taken of them by the Host for advertising, promotional and marketing purposes. The Guest also waives their right to inspect or approve the eventual use of such photographs, however the Host will remove or obscure the identity of any images upon request by the Guest.
GENERAL TERMS OF USE
8. OCCUPANCY
The Guest acknowledges that they will personally occupy the Cottage for the entire rental period. Sub-letting of the Cottage is not permitted. Where separate parties will be occupying the Cottage at different time periods (with advance approval by the Host), each party must agree to these Terms and Conditions.
The maximum number of people allowed overnight is as per the booking confirmation (“Booking”). Additional occupants, whether staying overnight or not, must be registered with the Host and may be subject to additional fees. Guests who contravene the maximum number permitted will be subject to either immediate eviction without refund or an additional per occupant charge, at the discretion of the Host. Please note that ANY person, regardless of age is counted as a person in the occupancy of a Cottage.
Unreasonable noise that leads to complaints by other guests or neighbours may result in immediate eviction without refund. “Quiet hours” are between 11:00pm and 7:00 am, whereupon the Guest is expected to minimize noise outside of their Cottage.
The Guest agrees that the Cottage is for recreational purposes only and shall not be used for any commercial or unlawful purpose.
The Guest agrees that the Cottage is not the primary residence of the Guest nor any of its occupants during the rental period and as such is not governed under the Ontario Residential Tenancies Act.
9. COTTAGE POLICIES/CLEANING/INVENTORY
The Guest agrees to read and abide by the Resort Policies, Rules and Procedures, as posted on the Website, on the Resort, in the Guest “App” Booklet and provided in each Cottage, and to use the inventory and equipment contained therein in a safe and responsible manner. The Guest agrees to leave the Cottage, including all furniture, fixtures, and chattels in the same state of repair and condition that they were in upon the start of the rental period.
The Guest agrees to leave the Cottage in the same state of general cleanliness and general order in which it was upon the start of the rental period. Extra cleaning, beyond the reasonable and standard cleaning that is typically required, will be charged at a rate of $50 per hour to complete the cleaning.
Breakage or damage to Cottage inventory, Resort equipment (including kayaks, paddle boats, canoes) or any other part of Resort (“Equipment”), above and beyond normal “wear and tear” will result in charges to the Guest based upon the cost to replace or repair the Equipment.
Any discrepancies or damage to the provided Equipment are to be reported to the Host within 12 hours of arrival, otherwise the Equipment will be deemed to be in good working condition.
All or part of the Damage Deposit may be used for penalties, fees, charges, additional cleaning required, breakage or damage to inventory, Equipment or any other part of Cottage or Resort above and beyond normal “wear and tear” at the sole discretion of the Host. The Guest agrees to assume responsibility for any and all costs and charges in excess of the Damage Deposit.
10. PETS/SMOKING
With advance permission from the Host, up to 2 pets per Cottage are permitted on the Resort, with some restrictions on where pets are allowed on the Resort. Guests will be charged an $80 “Pet Cleaning Fee” per pet and may be subject to additional charges if damage or additional cleaning is required. Any evidence of pets in non-designated Cottage or when not preapproved may be subject to additional charges, above and beyond the standard pet cleaning fee.
Guest is solely responsible and liable for their pet’s behaviour and actions while at the Resort. Guest acknowledges their responsibility for care of the pet(s) while at the Resort.
Pets must remain on a leash at all times and must not be left unattended in the Cottage unless they are in their crate/pet enclosure and they are quiet. Pets are not permitted on the beach or common indoor spaces, such as the Store or the Games Room and owners are responsible for cleaning up any fecal matter and disposing of it properly.
Smoking in the Cottage is not permitted under any circumstances. This includes cannabis, e-cigarettes, and tobacco.
Smoking inside this “no smoking Cottage” or allowing pets on the premises without prior agreement by the Host will result in a penalty fee of $200 and may result in immediate eviction without refund.
11. HEALTH & SAFETY
The safety of guests and staff at the Resort is of the utmost concern to the Host. The Host has taken every precaution to clean thoroughly but does not take responsibility for allergies or other conditions arising at the Cottage resulting from previous guest usage or materials within the Cottage.
The Guest is responsible for adhering to all posted health and safety policies and laws, including those related to water and watercraft/vehicle safety, bon fires/flammable objects and physical safety measures. Furthermore, the Guest, Staff and Host are required to follow Public Health guidance related to any relevant pandemic measures, including but not limited to respecting public and private gathering sizes, occupancy restrictions, mask wearing in common indoor Resort facilities, physical and social distancing measures and frequent handwashing. Host will ensure that frequent cleaning and sanitizing of surfaces is practiced. Guests who require accommodation measures are asked to advise the Host, so that they may work together to find suitable alternatives.
Violence, Bullying, Physical/Verbal/Sexual Harassment, or Discrimination related to protected grounds by or to guests, staff or Host will not be tolerated and is not permitted under any circumstances. Guests who are deemed to have partaken in bullying or harassing behaviour or exhibiting violence towards anyone on the Resort may be immediately evicted without a refund and/or charges may be subject to charges by the local law enforcement.
Non-adherence to Health and Safety measures may result in immediate removal from the Resort without a refund.
Terms of Use
ASSUMPTION OF RISK
Guest is aware that the use of the premises, Equipment and outdoor and water related activities in general involves risks, dangers and hazards, and that injuries arising from their use are common and ordinary occurrence. Guest understands that the Equipment provided under this agreement has inherent limitations in respect of providing for their personal safety in any or all circumstances. The Equipment provided may be subject to sudden or unforeseen mechanical breakdown. The Equipment provided has limited ability to withstand natural forces, including but not limited to, high winds, rough water conditions and the forces that result from impact with objects. It is impossible to predict every situation in which the premises, land, water and Equipment will be used and there is no guarantee, expressed or implied, that the user will not be injured as a result of their use of the Equipment and or premises.
INDEMNITY
The Guest agrees to release, indemnify and hold the Host, its directors, officers, employees, agents and
representatives (“Indemnified Parties”) harmless against any and all loss, claims, causes of action, demands and/or costs and expenses that may be incurred by the Guest or by any party in relation to the Cottage rental. It is understood by the Guest that the Indemnified Parties will not be liable whatsoever for any loss or any injury to the Guest or guests using the Equipment, Cottage, Resort and its content during the rental term, however caused. The Guest acknowledges that the Cottage, Resort and Equipment are provided for the Guest’s use at their own risk. The Guest and its guests are responsible for exercising due care and diligence in using the Equipment such as kayaks, life jackets, barbeque, bunk bed, stove, etc. In addition, the Indemnified Parties accept no liability for loss of or damage to the Guest’s possessions at the Resort.
